Legislative vs Judicial
Jul. 12th, 2004 03:05 pmI can't speak for our representatives in Congress, but I was raised to respect the institution of law and the concept of judicial review, and it sickens me as a citizen to turn on CSPAN-2 and see a U.S. Senator stopping just short of slandering the judges of the national and state Supreme Courts. These judges are not "activist" judges set out to "undermine the legislative process". They are performing their sworn duty of judicial review; interpreting the law as it relates to the US and State constitutions. Allowing gay marriage is not a judicial failure, it is a legislative failure: If the people don't want gay marriage, they should clarify the constitution in question through the well-established process of amendment. The fact that these very senators are pursuing such an amendment indicates to me that they do indeed understand the concept of judicial review, and are simply grandstanding for their constituents. Shame on them for showing such disrespect for the judicial system.
